Terms and Conditions and Protection of Access to Information Act

IIn order for us to offer you a seamless and "hassle free" holiday, we need to make you aware of our Terms and Conditions. If you want to contact us at ANY stage, just email us or click here and a consultant will contact you during our business hours.

1. TOUR FEE
Prices quoted on our web site and also in correspondence, are based on accommodation prices, land costs and rates of exchange at the date indicated above. The following methods of payment are acceptable; cash, bank transfer and cheques. We reserve the right to adjust prices in accordance with input cost increases and currency fluctuations.
 
2. NOT INCLUDED
Not included in the prices are the following: flights (unless clearly indicated); visas and passport costs; travel insurance ( unless specified ), any direct costs incurred by clients on the way, in - and on the way back from the resort other than those clearly indicated in the offering; any personal expenses or any other costs not clearly indicated in our offerings. We will not and do not offer any Bill Back facilities.
 
3. RESERVATIONS
On confirmation of the booking, a 20% NONREFUNDABLE deposit is due within 72 hours of same confirmation having been sent to the client. The balance is due 8 - 12 weeks prior to departure. We reserve the right to cancel any reservation if any moneys due have not been received by due dates. The deposit will be forfeited in this case. Once the full price has been paid we guarantee the prices will not change, unless increases are outside of our direct control. Any flight prices are subject to the normal terms and conditions of the air carrier and golfAustria absolves itself of any responsibility in this instance.
 
4.

FINAL PAYMENT and LATE BOOKING FEE
Clients paying in any other currency other than EURO are subject to the rate of exchange as provided to us by First Forex . Since we price in EURO, if a client wishes to make a FULL payment we MUST first get a Forex rate from the bank, book the forex transaction and then recalculate the entire package and send you a final invoice. Once we are in the payment window of 8 - 12 weeks prior to travel, the exchange rate and final invoice is binding. We do not benefit from exchange rate fluctuations in any way and can not be held responsible for the fluctuations in any way. Once the Rate of Exchange has been fixed for a client, we can not reverse this process and payment is due within the stipulated time frame.

Prices quoted are subject to fluctuations in exchange rate and any unforeseen price changes – rates will only be guaranteed on receipt of full payment IF golfAustria has provided the client with the rate ( as given to it by the bank ) after the quote stage and entering the final payment stage. Please note that while an indication rate of the exchange has been used in the quoting stage, the entire package will be recalculated at the prevailing rate of exchange as supplied to us by the financila institution of our choice and this creates a valid and binding foreign exchange contract.  Deposit amounts paid are done so on the indication rate and have no bearing on the final rate of exchange used. The deposit is merely a measure of confirming the travel package.

golfAustria Tours is entitled to charge an additional amount as a late booking service fee, which amount shall not be more than 25% of the total advertised price.

 
5. CANCELLATION CONDITIONS
In the event of a client wishing to cancel their arrangements, this cancellation must be made in writing and sent to us by registered post. golfAustria will be entitled to charge cancellation fees according to the following table:
> 10 weeks prior to travel forfeiture of full deposit
10 weeks prior 35% of the tour fee
8 weeks prior 50% of the tour fee
6 weeks prior 75% of the tour fee
< 6 weeks prior 100% of the tour fee


En route cancellations or amendments any incur additional fees which will be bourne by the client.

Payments not made by due date, as specified for a transaction, will attract interest at prime plus 2% pa, calculated daily, on the outstanding balance until paid in full. Any costs incurred by golfAustria Tours to recover outstanding monies, are bourne by the client.

 
6. CHANGES AND AMENDMENTS
Any changes and amendments to confirmed bookings may attract a service fee of EUR 50.00 - if these are made within 8 weeks prior to travel, then a cancellation fee may apply. If any documents have to be reissued, the service fee will be EUR 50.00
 
7. AIRPORT TRANSFERS
All scheduled transfers originate in Munich or Zurich (depending on resort) and will occur on a Saturday (unless specifically arranged). In the event that the client misses or alters the transfer, golfAustria can not be held responsible for this inconvenience and any travel arranged by the client in this regard is for the account of the client. If any flights are missed due to the transfer being late are also not the responsibility of golfAustria - again costs incurred in this regard by the client is for his/her account. Transfers may be done by coach, minibus, van, car or train.
 
8. ACCOMMODATION
All accommodation has been selected to suit the clients needs and specific hotels/pensions are not illustrated which enables golfAustria to offer lower prices. The standard resort in the category pension will always be a minimum of B grade and in the category hotel will be to the star rating as indicated. Resorts have also chosen to reflect the ambiance and hospitality which is truly Austrian.
 
9. GOLF &OTHER EQUIPMENT
All equipment rented by the client is the client's responsibility. golfAustria is entitled to recover any costs from the client should they occur. All responsibility for equipment while in the client's possession rests with the client and this obligation will only be terminated once the lendor accepts responsibility for equipment returned. In all of these instances, golfAustria has the right to recover any costs from the client as well as charge an admin fee of R250.00 per incident.
 
10.

GOLFAUSTRIA RESPONSIBILITY
It is expressly acknowledged and agreed that golfAustria is an agent for all accommodation, transfer, equipment hire, service and flight providers and thus can not accept ANY responsibility should any service not perform according to expectations. In addition, golfAustria shall not be liable for any loss, damage, injury, delay or any other irregularity which the client may experience.
golfAustria does not hold itself responsible, nor can it be held responsible for delays during any part of the trip for which it was employed to give services as an agent. Any additional expenses will be for the account of the client. golfAustria Tours will at all times take utmost care in the selection of golf resorts suitable for client's and time of year but can not be held responsible for any act of God. The lack of or abundance of snow is outside of the control of golfAustria Tours and should some or all golf runs be closed at any stage, refunds or delayed trips will not be entertained.

 
11. REFUND POLICY
NO refunds will be made for any unused service for which the client has paid and will be treated in accordance with Clause 5 above as being within the 2 weeks time period, i.e. 100% cancellation.
 
12. TRAVEL DOCUMENTS
Any travel documentation in terms with services required / requested will only be issued on receipt of full and final payments. It is the responsibility of the client to insure that the correct documentation has been issued to them. Clients are ultimately responsible to check all documentation and also to ensure that Visas, re-entry permits, passport, vaccinations, inoculations, etc. are in order. Whilst golfAustria endeavours to issue the correct documents and advise the clients correctly, golfAustria can not be held responsible for clients failing to ensure that correct documents have been issued nor if passport, visa or health stipulations have not been met.
 
13. TRAVEL AND MEDICAL INSURANCE
golfAustria advises the client to take out insurance against cancellation, illness, loss of baggage, medical, personal liability, or any other reason for which insurance would be appropriate. Where we provide travel and medical insurance as specifically listed in our packages under inclusions, we use the services of a third party and we can not be held responsible for their performance, or lack thereof. If you have taken Travel & Medical Insurance with us, then this insurance only becomes active 14 days AFTER your final payment to us but always before your first day of travel.
 
14. GOLFAUSTRIA TOURS
is a trading entity golfAustria Tours CC and registered in South Africa and referred to as golfAustria or golfAustria Tours.
 
15. By making use of any services of golfAustria Tours, the client acknowledges all of these conditions and accepts all terms and conditions, tacit or implied.

Protection of Access to Information Act

This manual has been compiled in accordance with the Promotion of Access to Information Act, 2000 ("Act�). The preamble to the Act, which is self explanatory, is set out below:

�ACT�

To give effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights, and to provide for matters connected therewith.

RECOGNISING THAT �

the system of government in South Africa before 27 April 1994, amongst others, resulted in a secretive and unresponsive culture in public and private bodies which often led to an abuse of power and human rights violations;

section 8 of the Constitution provides for the horizontal application of the rights in the Bill of Rights to juristic persons to the extent required by the nature of the rights and the nature of those juristic persons;

section 32(1)(a) of the Constitution provides that everyone has the right of access to any information held by the State;

section 32(1)(b) of the Constitution provides for the horizontal application of the right of access to information held by another person to everyone when that information is required for the exercise or protection of any rights; and

national legislation must be enacted to give effect to this right in section 32 of the Constitution.

AND BEARING IN MIND THAT�

the State must respect, protect, promote and fulfil, at least, all the rights in the Bill of Rights which is the cornerstone of democracy in South Africa;

the right of access to any information held by a public or private body may be limited to the extent that the limitations are reasonable and justifiable in an open and democratic society based on human dignity, equality and freedom as contemplated in section 36 of the Constitution; and

reasonable legislative measures may, in terms of section 32(2) of the Constitution, be provided to alleviate the administrative and financial burden on the State in giving effect to its obligation to promote and fulfil the rights of access to information.

AND IN ORDER TO�

foster a culture of transparency and accountability in public and private bodies by giving effect to the right of access to information; and

actively promote a society in which the people of South Africa have effective access to information to enable them to more fully exercise and protect all of their rights.�

Section 51(1)(f)

Form of request:

* The requester must use the prescribed form to make the request for access to a record. This must be made to the contact person of the private body. This request must be made to the address, fax number or electronic mail address of the body concerned [s 53(1)].
* The requester must provide sufficient detail on the request form to enable the contact person of the private body to identify the record and the requester. The requester should also indicate which form of access is required. The requester should also indicate if any other manner of communication is to be used to inform the requester and state the necessary particulars to be so informed [s 53(2)(a) and (b) and (c)].
* The requester must identify the right that is sought to be exercised or to be protected and provide an explanation of why the requested record is required for the exercise or protection of that right [s 53(2)(d)].
* If a request is made on behalf of another person, the requester must then submit proof of the capacity in which the requester is making the request to the satisfaction of the contact person of the private body [s 53(2)(f)].

1. The fee for a copy of the manual as contemplated in regulation 9(2)(c) is R1,10 for every photocopy of an A4-size page or part thereof.

2. The fees for reproduction referred to in regulation 11(1) are as follows:


(a) For every photocopy of an A4-sized page or part thereof R1,10


(b) For every printed copy of an A4-sized page or part thereof held on a computer or in electronic or machine-readable form R0,75


(c) For a copy in a computer-readable form on



(i) stiffy disc R7,50

3. The request fee payable by a requester, other than a personal requester, referred to in regulation 11(2) is R50,00.

4. The access fees payable by a requester referred to in regulation 11(3) are as follows:


(1) (a) For every photocopy of an A4-size page or part thereof R1,10



(b) For every printed copy of an A4-size page or part thereof held on a computer or in electronic or machine-readable form R0,75



(c) For a copy in a computer-readable form on

(2) For purposes of section 54(2) of the Act, the following applies:



(a) Six hours as the hours to be exceeded before a deposit is payable; and



(b) one third of the access fee is payable as a deposit by the requester.





(3) The actual postage is payable when a copy of a record must be posted to a requester.

(5) Notice of internal appeal, as contemplated in Section 75(1) of the �Act�, must be lodged in the Form C of the Annexure.

(6) The appeal fees payable in the respect of the lodging of an internal appeal by a requester against the refusal of his or her request for access, as contemplated in section 75(3)(a) of the �Act� is R50.00.
